Terms of service.

The operating agreement for gyms using Kasratbook to run members, billing, attendance, messaging, and growth.

01Agreement

These Terms of Service govern your access to and use of Kasratbook, including the website, dashboard, member portal, APIs, integrations, messaging tools, billing tools, attendance tools, class and PT modules, and related services.

By creating an account, starting a trial, using the product, or accessing a workspace, you agree to these terms. If you use Kasratbook on behalf of a gym, company, partnership, or other organization, you confirm that you are authorized to accept these terms for that organization.

Clicking an “I agree” checkbox, creating an account, completing onboarding, accepting an order form, or continuing to use Kasratbook after notice of updated terms may form an electronic contract under applicable law.

02Platform operator

Kasratbook is a software product of ORDER CRAFT, the trade name of SAVALIYA PARTH HASMUKHBHAI, a Proprietorship. References to “Kasratbook”, “we”, “us”, or “our” mean this platform, product, and its operator.

03The service

Kasratbook helps gyms manage members, staff, leads, subscriptions, invoices, payments, dues, attendance, biometric devices, classes, personal training, products, expenses, reports, WhatsApp communication, member portal access, and related gym operations. Features available to you may depend on your plan, configuration, country, payment provider, and enabled integrations. We may add, improve, change, rename, limit, or remove features as the product evolves, including where needed for security, reliability, legal compliance, provider-policy changes, or better product design.

04Accounts and security

You are responsible for keeping your login credentials secure, choosing appropriate staff roles and permissions, reviewing who has portal access, and promptly removing access for staff who no longer work with your gym.

You must provide accurate account, gym, billing, and contact information. Account creation may be reviewed, limited, rejected, or suspended where information appears inaccurate, abusive, unlawful, high-risk, or likely to harm the platform or other customers.

You must notify us at [email protected] if you suspect unauthorized account access, credential theft, payment misuse, or a security issue affecting your workspace.

05Customer data

You retain ownership of the gym, staff, member, lead, billing, attendance, class, PT, product, and communication data you enter into Kasratbook. You grant us the rights needed to host, process, transmit, back up, display, and secure that data so we can provide the service.

You are responsible for collecting and using member and lead data lawfully, including obtaining any consent required for WhatsApp messaging, biometric attendance, health or fitness notes, payment reminders, and member portal access.

Where applicable privacy law treats Kasratbook as your processor or service provider, we process customer data on your documented instructions to provide the service, subject to these Terms, our Privacy Policy, and any written data processing terms we agree with you. If a separate data processing agreement is signed, it controls over these Terms for personal-data processing conflicts.

06Acceptable use

You agree not to use Kasratbook to:

  • break the law or violate another person’s privacy, intellectual property, or rights;
  • send spam, abusive messages, misleading offers, or unlawful marketing;
  • upload malware, attempt unauthorized access, or probe systems without permission;
  • misrepresent payment, invoice, tax, attendance, or membership records;
  • resell, rent, sublicense, or provide Kasratbook as a competing service without permission;
  • reverse engineer or attempt to extract source code except where law expressly allows it.

07WhatsApp and communications

If you enable WhatsApp, email, SMS, push notifications, or other communication channels, you are responsible for the content you send, the recipients you select, and compliance with provider policies, consent rules, opt-out requests, and applicable law. We may throttle, pause, or disable messaging that appears abusive, high-risk, or likely to harm deliverability for other customers.

Message delivery is not guaranteed. WhatsApp, email, payment reminders, OTPs, push notifications, and similar communications may fail, be delayed, be blocked, require template approval, depend on provider limits, or be affected by recipient devices, recipient settings, network conditions, spam filters, or third-party platform policies.

08Payments, billing, and taxes

Kasratbook may help you create invoices, collect payments, track dues, process refunds, and generate reports. Payment processing is handled by third-party providers such as Razorpay or other gateways you configure.

You are responsible for your gym’s pricing, discounts, GST/tax setup, refund decisions, invoice accuracy, statutory compliance, and member-facing payment terms. We provide tools, but we do not provide legal, tax, or accounting advice.

If you choose a paid plan, add a payment method, or authorize recurring billing, you authorize us and our payment providers to charge the applicable subscription, add-on, usage, tax, and renewal amounts according to the plan and billing settings you select. We do not store full card numbers, CVV values, UPI PINs, or banking passwords.

09Subscriptions and plan limits

Your Kasratbook subscription gives you access to the features, limits, and support level of your selected plan. Plan limits may include members, staff, branches, WhatsApp message volume, biometric devices, storage, or advanced modules.

We may update plan packaging or pricing from time to time. If a change materially affects an active paid subscription, we will notify you before the change takes effect.

Plan upgrades may take effect immediately, with unused value from the current paid period applied as a prorated credit where supported by your billing setup. Plan downgrades generally take effect from the next renewal or billing cycle.

If a downgrade places your account above a lower plan's limits, we will not delete existing gym data solely because of that downgrade. We may restrict new additions, premium features, or further usage until the account is brought within the applicable limits or upgraded again.

10Product development and preview features

Some Kasratbook features, including mobile apps, member-facing experiences, advanced automation, integrations, device support, AI-assisted tools, or other platform modules, may be released as beta, preview, early access, or in-development features. These features may be changed, limited, paused, or removed as the product evolves.

Beta, preview, advanced, or newly released features may require additional setup, eligibility, provider approval, compatible hardware, supported devices, staff training, or manual configuration before they work for your gym. Any timelines, demos, roadmap items, or upcoming feature references are shared for planning purposes and are not a guarantee of delivery unless expressly included in your written agreement with us.

11Trials, suspension, and cancellation

New accounts may receive a free trial. If the trial ends and no paid plan is active, access may be limited until the account is upgraded. If a paid invoice fails or remains unpaid, we may restrict new activity while keeping existing data available for review or export where reasonably possible.

Unless expressly stated otherwise at checkout, a trial does not automatically become a paid subscription without a deliberate upgrade, payment, order form, or other billing confirmation from the account owner.

You can cancel your subscription from billing settings or by contacting support. Certain records may remain retained after cancellation where required for security, tax, accounting, dispute resolution, or legal compliance.

Monthly plans may be eligible for free cancellation within 3 days of purchase or renewal. Annual plans may be eligible for free cancellation within 7 days of purchase or renewal. After the applicable window, cancellation stops future renewals and access usually remains available until the end of the paid period, unless the account is suspended under these terms.

After termination or cancellation, we aim to provide a reasonable export window, generally up to 30 days unless a different period is shown in the product or agreed in writing. After that period, we may delete or archive customer data, subject to legal, accounting, fraud-prevention, backup, and security retention needs.

12Biometric devices and hardware

Kasratbook provides software integration with biometric attendance devices that support industry-standard ADMS protocol, including brands such as ZKTeco, eSSL, Realtime, and other compatible manufacturers.

Hardware is sold separately. Kasratbook does not manufacture, sell, or warranty biometric devices. You are responsible for purchasing compatible hardware from device manufacturers or authorized resellers, device installation, network connectivity, firmware updates, and compliance with applicable biometric data protection laws.

We provide software tools to sync attendance data from compatible devices. Device compatibility, sync reliability, firmware behavior, and manufacturer support are outside our control. We do not guarantee that every device model or firmware version will work perfectly with Kasratbook.

Biometric sync depends on the device brand, model, firmware, ADMS/protocol support, network setup, firewall rules, device clock, and manufacturer behavior. A device may require configuration by your vendor or IT team, and some devices may not support live sync, two-way sync, or all attendance events.

13Third-party services

Kasratbook integrates with providers such as payment gateways, WhatsApp providers, email providers, calendar tools, accounting tools, biometric devices, app stores, cloud services, and storage/CDN providers. Third-party services are governed by their own terms, policies, technical limits, review processes, and availability.

Features that depend on third-party providers may be unavailable, delayed, limited, or changed if the provider has an outage, rejects an account or template, changes an API or policy, charges additional fees, suspends access, blocks delivery, or stops supporting a feature, country, device, or integration path.

14Availability and support

We work hard to keep Kasratbook reliable, but no online service is guaranteed to be uninterrupted. Maintenance, provider outages, internet failures, payment gateway downtime, WhatsApp/provider restrictions, email-provider downtime, app-store review delays, device network issues, and force majeure events may affect availability.

Payment collection, payment status updates, refunds, invoice delivery, WhatsApp delivery, email delivery, OTP delivery, push notifications, biometric sync, and automated workflows may not always complete in real time or at all. Support channels and response times depend on your plan.

15Intellectual property

Kasratbook, including the software, design, documentation, workflows, branding, and underlying technology, belongs to us or our licensors. Your gym data remains yours. Feedback or suggestions you share may be used by us to improve the product without obligation to compensate you.

16Disclaimers

Kasratbook is provided on an “as is” and “as available” basis. We do not guarantee that every report, reminder, payment status, biometric sync, automation, or integration result will be error-free. You should review important financial, legal, tax, medical, and operational decisions independently.

17Indemnity

You agree to defend and indemnify Kasratbook against claims, losses, fines, costs, and reasonable legal expenses arising from your unlawful use of the service, your gym’s member-facing terms, your failure to obtain required consents or lawful bases, your communication content, your connected third-party tools, or your breach of these Terms.

18Limitation of liability

To the maximum extent permitted by law, Kasratbook will not be liable for indirect, incidental, special, consequential, punitive, or loss-of-profit damages. Our total liability for claims relating to the service is limited to the fees you paid to Kasratbook for the service in the 12 months before the event giving rise to the claim.

19Governing law

These terms are governed by the laws of India, unless a separate written agreement says otherwise. Before filing a formal claim, both sides agree to first try to resolve the dispute in good faith by written notice and discussion for at least 30 days.

If the dispute is not resolved informally, courts in Pune, Maharashtra will have exclusive jurisdiction, unless a different forum is required by applicable law or agreed in writing.

20Changes

We may update these terms as the product, law, or business changes. If we make material changes, we will notify customers through email, in-product notice, or another reasonable channel. Continued use of Kasratbook after the effective date means you accept the updated terms.
